Terms of Service

These Terms of Service ("Terms") govern your use of the Emelio mobile application and related services (the "Service"), provided by Matt Reid ("Emelio", "we", "us"). By downloading or using Emelio, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility (13+)

You must be at least 13 years old to use Emelio. If you are under the age of majority where you live, you may use Emelio only with the involvement of a parent or guardian.

2. Your license to use Emelio

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial guitar practice and learning. You may not copy, resell, reverse-engineer, or redistribute the Service or its content except as allowed by law.

3. The AI tutor: important disclaimer

Emelio's tutor is an automated AI system, not a human teacher. Its feedback, lessons, and suggestions are generated automatically and may be incomplete, inaccurate, or wrong. Emelio is a practice aid and is not a substitute for professional music instruction. Do not rely on it as your sole source of truth or as a substitute for professional advice; you use its feedback at your own risk. Use your own judgment; play safely and stop if anything causes discomfort or pain.

5. Your content

You retain ownership of the tabs, photos, and other content you upload. You grant us a limited license to store and process that content solely to provide the Service to you (for example, to convert an uploaded tab into a playable version). You are responsible for having the rights to any content you upload.

6. Copyright complaints

If you believe content available through Emelio infringes your copyright, email support@emelio.ai with a description of the work you believe is infringed, where the material appears in Emelio (enough detail for us to find it), and your contact information. We review complaints promptly and remove infringing material where appropriate. We may suspend or terminate the accounts of users who repeatedly upload infringing content.

7. Acceptable use

Don't use Emelio to break the law, infringe others' rights, upload content you don't have the rights to, or interfere with or misuse the Service.

8. Third-party services, availability & beta features

Parts of the Service, including the AI tutor, rely on third-party providers such as AI-model and cloud-infrastructure providers. We may change, suspend, or discontinue features of the Service, including where a provider changes its service, terms, or pricing. Some features may be labeled beta or experimental; they may change or be withdrawn and may be less reliable than the rest of the Service. We do not guarantee that the Service will be uninterrupted or error-free.

To the extent permitted by applicable law, you agree to compensate us for third-party claims, and reasonable related costs, caused by content you upload that infringes another person's rights or by your material breach of these Terms.

We may update these Terms or the Service. Material changes take effect when we post the updated Terms (reflected by the "Last updated" date). You may stop using Emelio at any time; we may suspend or terminate access for violations of these Terms.

13. Governing law & disputes

These Terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country where you live; nothing in these Terms, including this choice of law, takes away rights granted to you by those mandatory provisions. Disputes may be brought before the competent courts of Switzerland or, where mandatory consumer-protection rules so provide, the courts of your place of residence.

14. General

If a provision of these Terms turns out to be unenforceable, the rest stays in effect. We may assign these Terms to a successor of the Emelio business (for example, if a company is formed to run Emelio); you may not assign them. If we don't enforce a provision, that is not a waiver. These Terms are the entire agreement between you and us about the Service.
